Don,

I have emailed you numerous times about my adirondak chairs. I wish you would respond to me so I can atleast move ahead. AM I GETTING THE CHAIRS?????? If not please credit my credit card. I would like to know what is going on. You seemed so nice on the phone when I ordered these chairs, full of information!!!!! I only wish you would give me a response, just so I can move on and start looking for other furniture if I am not getting yours. PLease RESPOND!!!!!!!!!!!!!!!!!!!!!!!!!!!

I had told you that I was moving into my house in October and you said that I would have my palm tree headboard in plenty of time. I do not have it yet. I can not be nice about it any more. Either I want my headboard or my deposit back !!!!!!!!

From reading all these posts I can't believe this guy is still in business! I think Coastal Living Magazine needs to make a statement about this guy since they have been showing his furniture and enticing its readers. Can't you all call your Credit Card company's and dispute the charges? I really feel for you all especially since his stuff isn't inexpensive. Best of Luck!

P.S. this is just my opinion.

I contacted Coastal Living and got nowhere with them as I requested that they do exactly that last August. Basically, they say it has nothing to do with them. Too bad as that would be a good way to get the word out. I contacted both the BBB and the Georgia Attorney Generals office and got nowhere with them either as they say that their mail was returned undeliverable--there seems to be no apparent way to stop someone from swindling many people. Frustrating to think there is no way to go after this guy and stop him as he is definitely NOT a man of his word, despite what he has written in these posts. Actions speak louder than words and that is what I base my opinions on.

Too bad were all in this situation with this Don Kell.

I have noticed that you refunded a customers money in a previous post. I am so over dealing with this problem!!!!!!!!!!!!!!!!!! Can you please credit my credit card , so I can finally move on and not deal with this ANYMORE!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! !!!!!!!! I think this is the least you can do, after all the time I have given you.

Good luck with that! Don did not himself credit my card, he would not even respond to me, so I had to file with my credit card company to get a conditional credit. Unfortunately, the chargeback goes against Good Karma Art Galleries instead of Don Kell as he was clever enough to run everything through them since he had no business license at the time. They paid him in cash once the charge went through, and now they are out all this money! Don hasn't returned any of my numerous e:mails or calls in months...he's MIA. I'd suggest that you quickly contact your credit card company and get a chargeback.

I looked Don up again in the Gwuinett County Court system and found there are several new cases posted against him. The two newest ones indicate that warrants were issued from jail. Perhaps this is the reason no one has heard from him.

As I noted in my post the other day, it appeared that Don was in Jail as there were warrants issued from Jail.

After further research, Don Kell was arrested on two counts of FELONY theft in late September (around Sept 21st). He has been released on bail and has a court case pending on the two felony counts. The case has not been assigned to a judge yet per the Gwinnett County Courthouse.


I urge each one of you who have lost money to this man to contact the Gwinnett County Police Department and file a charge against this man. To file a police report, contact the Gwinnett County Police Department at 770-513-5190. The chief of police is Charles Walters. Once that has occured, you can then notifiy the Gwinnett County District Attorneys office. Their phone number is 770-822-8400. His case number is 06-48-31. They may not do anything until the case has been assigned to a district attorney so you might have to call back a few times until it's assigned. None the less, if you are frustrated about being taken by this person and want to do something about it, invest the time. Collectively, he's taken quite a bit of money from us.

A reminder that this is mail fraud and that is a federal offense. You can file a charge with your local post office or go to www.usps.com for more information. The law reads:

The Federal Statute reads, “Whoever, having devised or intending to devise any scheme or artifice to defraud, or for obtaining money or property by means of false or fraudulent pretenses, representations, or promises, or to sell, dispose of, loan, exchange, alter, give away, distribute, supply, or furnish or procure for unlawful use any counterfeit or spurious coin, obligation, security, or other article, or anything represented to be or intimated or held out to be such counterfeit or spurious article, for the purpose of executing such scheme or artifice or attempting so to do, places in any post office or authorized depository for mail matter, any matter or thing whatever to be sent or delivered by the Postal Service, or deposits or causes to be deposited any matter or thing whatever to be sent or delivered by any private or commercial interstate carrier, or takes or receives therefrom, any such matter or thing, or knowingly causes to be delivered by mail or such carrier according to the direction thereon, or at the place at which it is directed to be delivered by the person to whom it is addressed, any such matter or thing, shall be fined under this title or imprisoned not more than five years, or both. If the violation affects a financial institution, such person shall be fined not more than $1,000,000 or imprisoned not more than 30 years, or both.”

That would explain why he hasn't called me in a while.
For most of the summer, he'd call every day, trying to process my order for a 'palm tree' headboard.
I didn't call him back because I wanted to pay by check (eek!!!), but hadn't set up a new account yet.

I'm so sorry y'all are going through this!!!
But, by the same token, I'm happy to have stumbled onto this board...otherwise, I too, would have been shafted.

Again...I'm hoping it all works out for you.

If I happen to find another (honest) craftsman who can build furniture as Don can, I will post the name.

I WANT A PALM TREE HEADBOARD! LOL...and by gawd, I'm gonna find one. :D

If you find a palm tree headboard, let me know. I found 2 companies but each want upwards of $900 for a full size headboard!!! I think that is a little steep.
